Enviromental impact report

1. Environmental impact report: in accordance with Article 66 of the Act of 3 October 2008 on sharing information on environment and its protection, public participation in environment protection and on environmental impact estimates, the environmental impact report should consist of:

1) Description of a planned project, and especially:

  • characteristics of the project and conditions of land use during the construction phase, exploitation or utilization,
  • main characteristics of production processes,
  • predicted types and amount of pollution resulting from the functioning of the planned project.

2) Description of the nature elements of the environment within the predicted impact range of the planned project on environment including nature elements under protection under the Act of 16 April 2004 on Nature Conservation.

3) Description of the historical buildings and monuments under protection existing in the neighborhood or close to the area within the impact range of the planned project under the provisions of the of historical monuments and buildings preservation and care of them.

4) Description of predicted effects on environment in case of not starting the project.

5) Description of the analyzed options, including:

  • option proposed by the applicant as well as rational, alternative option,
  • the best option for environment together with justification for the choice.
    • 6) Determination of the predicted impact on environment of the analyzed options including a case of a major industrial accident and also possible transgenic impact on environment.

      7) Justification of the option proposed by the applicant including its impact on environment, especially on:

      • people, plant, animals, mushrooms, habitats, water, air,
      • surface of the earth including the land mass movements, climate and landscape,
      • material goods,
      • historical buildings and monuments, cultural landscape under existing documentation especially under the register of historical monuments and historical records,
      • interaction between the elements mentioned in the above points.

      8) Description of projected methods used by the applicant and the description of predicted significant impact of the planned project on environment, including direct, indirect, secondary, accumulated, short-term, mid-term and long-term, permanent and temporary impacts on environment resulting from:

      • project existence
      • use of environmental resources
      • emission;

      9) Description of the projected activities aiming at conservation, limitation or natural compensation of the negative effects on environment, especially on the aims and the object of an area conservation Natura 2000 as well as its integrity.

      10) For the ways which are undertakings with the significant impact on environment:

      • determination of assumptions to:
        – rescue study of identified historical buildings and monuments on the are of the planned project discovered during construction works,
        – protection program of existing historical buildings and monuments against the negative impact of the planned project and conservation of cultural landscape.
      • analysis and assessment of possible threats and damages of protected historical buildings and monuments under the provisions of historical buildings and monument preservation and care of them, especially archeological finds existing in the neighborhood or close to the range of the impact of the planned project

      11) If the planned project requires the use of installation, then there is a comparison of the suggested technology with the technology which meets requirements of the Article 143 of the Act on Environment Protection Law of 27 April 2001.

      12) Indication, whether it is necessary to establish an area of limited use under the provisions of the Act on Environment Protection Law of 27 April 2001, and setting the boundaries of such an area, limitations in the land use, technical requirements for buildings and their use; does not apply to projects concerning local roads construction.

      13) Presenting issues in a graphic form.

      14) Presenting issues in a cartographic form in a scale corresponding to the object and details of the analyzed issues found in the report and enabling comprehensive presentation of the carried out analysis of the impact of the project on environment.

      15) Analysis of possible social conflicts arising due to the planned project.

      16) Presenting suggested monitoring process of the planned project impact at the stages of its construction and utilization, especially on the aims and an object of an area conservation Natura 2000 as well as its integrity.

      17) Indicating obstacles resulting from insufficient technology or gaps in modern knowledge met during preparation of the report.

      18) Summary of the information included in the report written in a non-professional language, regarding each element of the report.

      19) Names of person or persons preparing the report.

      20) Sources of information which were the basis for the report preparation.

      2. Information included in the Act 1 point 4-8 should include predicted impact of the analyzed options on the aims and an object of an area conservation Natura 2000 as well as its integrity.

      3. In the event of stating the possibility of transgenic impact on environment, information included in Act 1 points 1-16 should take into account the determination of the planned project impact beyond the territory of Poland.

      4. If it is necessary to establish an area of a limited use for the planned project, a certified copy by the competent organ of a cadastral map with marked boundaries of an area where it is necessary to establish an area of a limited use should accompany the report; does not apply to the local roads construction.

      5. If the planned project requires the use of installation which is subject to obligation of obtaining an integrated permission then the report on the impact of the project on environment should contain the comparison of a suggested technology with the best available ones.

      6. The report on environmental impact of the project should take into account the impact of the project at the stages of its realization, exploitation or utilization and its liquidation.

      NOTE: Report on environmental impact does not need to include all points for each project. On the basis of the Project Information Sheet the authority in consultation with the Regional Directorate for Environmental Protection determines the ranges of the report for each individual project.

      NOTE: Obtaining environmental decision is a necessary condition to obtain any further decision regarding SHP construction.
